Kangana Ranaut has approached Dindoshi Sessions Court in Mumbai and challenged the proceedings before the Metropolitan Magistrate Court at Andheri in a criminal defamation complaint filed by lyricist Javed Akhtar against her for her statements made in a TV interview. The hearing of the case was adjourned to April 3, 2021.
Kangana Ranaut has filed a criminal revision application, challenging the order passed by the Magistrate, under which she was summoned to court. She alleges that she was summoned by the court without complying with the provisions of the Criminal Procedure Code. She has also challenged the action of issuing a bailable warrant against her.
Kangana Ranaut has prayed for a
stay and setting aside the summoning order dated February 1, 2021. She has also prayed for cancelling the bailable warrant issued by the Magistrate. In her petition, she has also sought an order from the Sessions Court to call for the entire papers and proceedings for examination and thereafter suspend all proceedings.
Admittedly, Akhtar’s complaint contained names that offer witnesses being Dr Ramesh Aggarwal, Dr Komal Nahata, Sharad Chaudhary and Carol Theresa Desouza.
However, Kangana Ranaut says that the Magistrate at Andheri passed the order of summoning her to appear in Court without examining the witnesses on oath, as was stipulated under Section 200 of the Code of Criminal Procedure.
