Dipesh Sawant, Sushant Singh Rajput's house help who is accused of procuring drugs for the late actor, has filed a writ petition before the Bombay High Court against the Narcotics Control Bureau (NCB), seeking Rs10 lakh in compensation. Dipesh Sawant has alleged illegal detention by the NCB in the drug case. The petition was filed on October 5. On Monday, October 19, the matter came up and was adjourned till November 6. The case will be heard by the division bench of Justice SS Shinde and Justice MS Karnik. Dipesh Sawant was earlier granted bail form NCB's judicial custody.
Sushant Singh Rajput died by suicide on June 14. Currently, three central agencies, including the Central Bureau Of Investigation (CBI), the Enforcement Directorate (ED) and the NCB are investigation various angles in the Sushant Singh Rajput death case. The NCB is looking into a drug angle, under which Rhea Chakraborty, Sushant's girlfriend, along with her brother, Showik Chakraborty, his house
help Dipesh Sawant were arrested. They were all charged for procuring drugs for the late actor.
In the petition, Dipesh Sawant has alleged that he was produced before the Magistrate after more than 36 hours of arrest. This straightaway violates the guidelines of the Supreme Court that states that an accused has to be presented before a Magistrate within 24 hours of arrest.
Dipesh Sawant further alleges in his petition that while the NCB has shown he was arrested on September 5 at 8 pm in their records, the arrest was made on September 4 at 10 pm and he was produced before the magistrate on September 6.
Dipesh Sawant has demanded Rs 10 lakh in compensation from the NCB for wrongly arresting him and then not following protocol.
The petition was filed through Advocates Rajendra Rathod and Aamir Koradia. “Two hearings have happened in the court. NCB has asked for more time to reply,” said Rathod.
