The legal guardian for Dajerria Becton, who was 15 at the time of party, filed the lawsuit on her behalf.
The suit says the girl was invited to the party and not accused of breaking laws.
Casebolt resigned following the incident which aggravated distrust of the police by black communities in the US.
The Grand Jury decided not to indict Casebolt in June of last year.
Ms Becton is suing Casebolt individually and in his capacity as a police officer.
