SC to examine triple talaq on constitutional principles

The Supreme Court on Wednesday agreed to examine “triple talaq” and other issues under the Muslim Personal Law on the touchstone of constitutional framework. The apex court also said that there was a need to debate as it affected a large section of people.

A bench of Chief Justice T S Thakur and Justice A M Khanwilkar refused to restrain NGO All India Muslim Personal Law Board from airing its view on the subject even as the matter remained pending for examination before the court. “This is very important issue and affects a large number of people,” the bench said, agreeing to hear all stakeholders.

“We are straightaway not jumping to any



conclusion. It has to be seen if there is a need for any further consideration of law by the Constitution bench,” the bench observed as a counsel representing AIMPLB contended that the apex court had previously declined to look into the issue. The court said personal law has to be tested on the touchstone of constitutional framework. Woman advocate Farah Faiz urged the court to restrain AIMPLB and others from airing their views on public platform including TV debates.

“We will not be influenced by TV shows. You can also participate in TV shows. We will keep your application pending. If at any stage we find that they are going out of hand," the bench said.
