The Supreme Court on Friday will hear a plea by Major Aditya Kumar's father, seeking to quash an FIR against his son and other army personnel for firing in J&K's Shopian on January 27, resulting into death of three civilians.
A three-judge bench presided over by Chief Justice Dipak Misra agreed to consider the writ petition filed by Lieutenant Colonel Karamveer Singh, on behalf of his son, claiming that the FIR would have "numbing effect on the morale of the extremely courageous and
professional Armed Forces of the Nation."
The court fixed the petition for hearing on Friday on urgent mentioning made by Singh's advocate Aishwarya Bhati.
The Army convoy, operating in the area covered under the Armed Forces Special Powers Act (AFSPA), was attacked by an unruly mob and they got hold of a junior commissioned officer and were about to lynch him, forcing the personnel to open fire lawfully as part of their bonafide duties, the petitioner claimed.
