The Supreme Court has sought the central government's views on a petition challenging the Triple Talaq and Polygamy practices in Muslim religion. Admitting a plea filed by a Muslim woman Shayara Bano from Uttarakhand, a two- judge bench of apex court yesterday issued notices to Union ministries of Law, Minority Affairs, and Women and Child development, seeking their views on the matter by 28th March.
The petitioner was divorced by her husband by uttering the word 'talaq' three times. Besides
challenging her divorce, the petitioner also challenged the Constitutionality of part of Muslim Personal Law Application Act, 1937 that seeks to validate practices of marrying multiple women, triple talaq and nikah halala.
Claiming these practices had no basis in Islam or Holy Quran, Shayara contended that their enactment continued to vex women despite clamour for reforms by several organisations, including the All India Muslim Women Personal Law Board and the Bharatiya Muslim Mahila Andolan.
