Supreme Court has stayed the Nainital High Court Order quashing the imposition of President's Rule in Uttarakhand. With this, Uttarakhand has again come under the President's Rule.
A Division Bench comprising Justices Dipak Mishra and Shiva Kirti Singh stayed the High Court's order till 27th of this month, when the matter will come up for further hearing before the Apex Court.
The bench also recorded an undertaking given by Atorney General Mukul Rohatgi that the Centre shall not revoke the Presidential proclamation till the next date of hearing. The Apex Court also asked Uttarakhand High Court to provide the copy of judgment to the parties by 26th of this month and the copy of the signed verdict should also be placed before the Supreme Court.
The Apex Court order came on a petition filed by
the Centre challenging the Uttarakhand High Court order that quashed the President's Rule in the state.
Supreme Court also pulled-up Uttarakhand High Court for not releasing a written judgment, saying it is more on propriety than legality. The Apex Court said what has been happening is a very serious and grievous matter for any state and President's Rule should not be revoked just like that.
Speaking for the Bench, Justice Singh said if he was the High Court Judge, he would have made the judgment operational only after three or four days when it is signed and ready.
He said, governance of a State cannot be left in the lurch. Justice Singh said interference by constitutional court in exercise of its power of judicial review pertaining to Presidential proclamation is a serious issue.
